Municipal Law: “Better a Park”
Article 1 – Establishment of the Program
The “Better a Park” Program is hereby established, aiming to transform abandoned private lots into public spaces for recreation, sports, and culture through partnerships between property owners and the municipality.
Article 2 – Objectives of the Program
I. Repurpose abandoned private lots to fulfill their social and environmental functions.
II. Reduce urban decay by revitalizing neglected areas.
III. Promote spaces that improve residents’ quality of life, encouraging outdoor activities.
IV. Increase tax revenue and compliance with municipal taxes.
Article 3 – Enrollment in the Program
I. Property owners may apply to the program by submitting a request to the municipality, provided that the lot:
a) Is registered in their name;
b) Is up to date with municipal taxes, including property tax (IPTU);
c) Meets the location and feasibility criteria defined by the Urban and Environmental Planning Department.
II. Upon enrolling, property owners commit to:
a) Making the lot available for public use during the agreement period;
b) Allowing necessary construction to transform the lot into a public space.
Article 4 – Benefits for Property Owners
I. Property owners participating in the program are entitled to:
a) A discount of up to 70% on property tax (IPTU) while the lot is in public use;
b) Possible exemption from maintenance-related fees for the lot during the agreement period.
Article 5 – Municipal Responsibilities
I. The municipality shall:
a) Assess the feasibility and community demand for the lot;
b) Undertake the necessary work to convert the lot into a public space, if approved;
c) Ensure the upkeep of the space, including cleanliness, safety, and adequate lighting.
Article 6 – Conversion into Public Space
I. Participating lots may be converted into:
a) Public squares with green areas and recreational facilities;
b) Community parks;
c) Outdoor sports spaces, such as courts, fitness areas, or walking tracks;
d) Cultural spaces, such as amphitheaters or exhibition areas.
II. The specific purpose of the lot will be determined through public consultation with the surrounding community.
Article 7 – Agreement Termination
I. The agreement may be terminated at any time by either the property owner or the municipality, provided that at least 90 days’ notice is given.
II. In cases of non-compliance by the property owner or the municipality, the agreement will be terminated, and any benefits granted will be revoked.
Article 8 – Final Provisions
I. The program will initially be in effect for 10 years, subject to renewal or adjustments based on its outcomes.
II. This law takes effect on the date of its publication.
This proposal encourages the use of abandoned lots, benefiting property owners and the community while fostering sustainable urban development.
